第三波制裁：巴丹島屬台灣
為反制漁民被菲律賓公務員以「海盜般的行為」射殺後菲國政府囂張的氣燄，台灣被迫進行聯合護漁演習。軍艦超越北緯20度的暫定執法線。但這條線代表何意義？是否有國際法基礎？
1895年日本透過〈馬關條約〉取得台灣後，立即與西班牙王國談判。八月七日當時外務大臣臨時代理西園寺公望與特命全權公使Don José de la Rica y Calvo簽署並交換〈有關西太平洋日西兩國版圖境界宣言〉（西太平洋ニ於ケル日西両国版図境界ニ関スル宣言）以確定兩國國境。
宣言提及「為此宣言，以通過巴士海峽之得以航行海面中央之緯度平行線，應為西太平洋日本國與西班牙國之版圖境界線。」（Pour le besoin de cette déclaration, le parallele qui passe par le millieu du Canal navigation de Bashi est pris comme ligne de démarcation entre les japanaises possession et espagnoles dans L'Ouest de l'océan Pacifique.）[1]
但到底這條「與緯度平行的國境線」在哪裡？
觀察呂宋海峽（Luzon Strait）中的巴林坦（Balintang）水道與我方北緯20度為主的暫定執法線重合，可推論：1895年所謂的巴士海峽應指目前的巴林坦水道。
沒錯！1898年美西戰爭後的〈巴黎和約〉，第3條規定，西班牙割讓給美國的菲律賓，其北界為「自西向東約北緯20度的可航行的巴士海峽」（A line running from west to east along or near the twentieth parallel of north latitude, and through the middle of the navigable channel of Bachi,）[2]
〈巴黎和約〉中北緯20度規定補充了研究者對1895年〈日西國境宣言〉文件的模糊。日、美兩當事國應知之甚詳──北緯20度線即為台灣與菲律賓的國境線。
從1895年起無論基於「國家繼承」或「政府繼承」原則，只要未被新劃界條約所取代，「此線以北屬於台灣」仍為有效。這不是所謂的「歷史主權」論，而是貨真價實的「國際法規定」。
學者對此有專文研究，如台灣海洋大學陳荔彤所長的〈暫定執法線的定位與功能〉[3] 與陳鴻瑜教授的〈巴丹島領土主權問題之研究〉[4]，外交部一定不陌生。
今年元月間美國掃雷艦保護者號（USS Guardian, MCM-5）在菲律賓吐巴塔哈（Tubbataha）國家公園擱淺而損害了4000平方公尺面積的珊瑚礁。馬尼拉成功扳倒美國政府並對之施以二百萬美元罰款的過往，或許是馬拉坎南宮氣志得意滿的力挺其公務員以「海盜般的行為」濫殺無辜台灣漁民的心理背景吧。菲國政府普遍性的腐敗，或許也是原因之一。
我們一定要這種無視人命、遊戲法律責任的政權知所進退、付出代價。台灣的第三波制裁應以北緯20度線為標的，包括：
1. 根據1895年〈日西宣言〉與美西1898年〈巴黎和約〉，宣布台灣與菲律賓的國境限為北緯20度。
2. 不承認菲律賓政府對巴丹群島的領土主張，其領土主權屬於台灣。
3. 海巡艦與軍艦即日起全時巡視巴丹群島直到領海基線周邊水域，無需受到〈國際海洋法公約〉領海與毗鄰區規定的限制。
上項政策與制裁，步步踏在國際法華爾茲的拍子上。誰曰不可？看誰還笑得出來？
