There are not only two parties which are A (the owner) and B (KSECO) in the main contract but are another two parties B (KAECO) and C (Bombardier) in the subcontract. What is more, there are parties A (the owner) and B’ (MATRA) in another contract since the two line, Mu-Cha and Nei-Hu designates to merges as one.
All the legal issues, including the patent, will bring the mayor’s head even bigger. They mean to loose or what?
看起來,市政府的口風「事後法律爭訟」是關鍵字,意即市府非常擔心此事,故先聲奪人。內湖線中「市政府(甲方)─工信(乙方)」,以及「工信(甲方)─龐巴迪(乙方)」形成的「市政府(甲方)─工信(乙方)─龐巴迪(丙方)」曲折法律關係,在加入他案木柵線的馬特拉後,那可真有得瞧的。這還只算捷運局,不算捷運公司。到時候,丙賠乙、乙賠甲,然後甲再賠給「他案之馬」。遇到專利,也都不是不可能的。扁北市府與馬特拉對決還是連勝,馬遇到馬特拉,就慘賠。反正,是公錢,沒有一位主事者會痛。但這一切,要去看契約如何規定才行。
北市:週刊內捷斷電報導不實 求償1億 ■中央社(2009.07.29)
(中央社記者孫承武、黃慧敏台北29日電)壹週刊報導內捷7月10日「大斷電」事件,北市府今天表示,報導不實,「廠商卸責,媒體幫凶」,將由台北捷運公司提民事求償1億元。壹週刊則指市府「十分荒謬可惡」。
壹週刊總編輯裴偉表示,台北市政府未就內湖捷運問題向民眾道歉,而且在責任未釐清前就指媒體報導不實,還指控媒體袒護廠商,「十分荒謬、可惡」。壹週刊7、8年來都是秉持公共政策辯論角度,爭取大眾權益,所做報導都可訴諸公論。
台北市政府法規會主委葉慶元、副秘書長譚國光、台北捷運公司副總經理趙雄飛等人出席記者會。葉慶元對壹週刊報導內容,以「倒因為果」、「指鹿為馬」形容,除表示遺憾也逐頁駁斥。
對文中引述「熟知內情人士」說法,葉慶元認為與承包商工信公司與機電系統承商「龐巴迪」有關,報導悖離事實,根本是「廠商卸責,媒體幫凶」。
葉慶元指出,由於台北市政府在雜誌出刊前已提出說明,基於維護北市府與台北捷運公司聲譽;加以目前與承商間合約還有一筆30億元工程尾款,為避免影響事後法律爭訟,將由台北捷運公司向壹週刊提出民事求償新台幣1億元。
葉慶元說,7月10日內湖線系統異常,應變疏散都是依「中運量行車規章」,捷運系統復電過程繁複,不可能有「突然復電,乘客行走軌道上遭高壓電擊」情事;至於雜誌報導行控中心電力系統「有另組開關」說法,更是子虛烏有。
另外,葉慶元指出,當天進入號誌房清查UPS不斷電系統檢測,由龐巴迪駐內湖機廠人員負責搶修,捷運公司派員一旁監督,並非捷運公司動手維修。雜誌指 「20日市長郝龍斌與龐巴迪代表會面紀錄事後銷毀」,葉慶元澄清,「自7月10日以後相關會議都要錄音,做成會議記錄」,媒體報導是惡意造謠。 980729

Project OverviewThe Department of Rapid Transit Systems (DORTS) has awarded a contract to Kung Sing Engineering Corporation (KSECO) for the construction of the Neihu Line rapid transit system. As prime sub-contractor to KSECO, Bombardier Transportation is providing all of the electrical and mechanical systems, including 202 vehicles, for the Neihu Line - an extension of the existing Muzha Line.
The new Neihu Line will incorporate 12 stations along 14.8 kilometres (9.2 miles) of dual-lane guideway. As part of the contract, Bombardier is also retrofitting the automatic train control system for the Muzha Line, the on-board train control of the 102 existing vehicles, as well as upgrading the existing Muzha Control Centre, which will be used as the redundant Control Centre for the entire Muzha-Neihu Line. The system is designed for a peak capacity of 28,400 passengers per hour per direction.
The 202 rubber-tired vehicles, to be configured in married pairs, will operate as 4-car trainsets. The configuration of the new vehicles will ensure the same functionality and physical interfaces as the original Muzha Line vehicles. Following the deployment of the Bombardier CITYFLO 650 automatic train control technology, both the new fleet of 202 vehicles and the original fleet of 102 vehicles will be capable of operating interchangeably on both the Neihu and Muzha Lines.
Bombardier's experience in systems engineering and integration will ensure the seamless transition from the existing Muzha Line fixed-block automatic train control system to the communications based CITYFLO 650 moving block automatic train control system. The CITYFLO 650 ATC system offers a high degree of flexibility and will allow for future expansion of service.
