根據 2024 年 3 月更新後的服務條款（Terms of Service），使用者在利用 Midjourney 生成圖片後，有幾點值得注意：
生成之內容為使用者所有
使用者擁有使用 Midjourney 所產出的創作，但不包括以下情況：
1. 使用者利用 Midjourney 放大了其他使用者創作之圖片的細節，此時這些放大的圖像仍然屬於原本的創作者。
2. 如果使用者是年收入超過 1 百萬美元的公司或其員工，則必須訂閱「Pro」（月繳 60 美金）或「Mega」（月繳 120 美金）方案才能擁有所有權。
You own all Assets You create with the Services to the fullest extent possible under applicable law. There are some exceptions:
- Your ownership is subject to any obligations imposed by this Agreement and the rights of any third-parties.
- If you are a company or any employee of a company with more than $1,000,000 USD a year in revenue, you must be subscribed to a “Pro” or “Mega” plan to own Your Assets.
- If you upscale the images of others, these images remain owned by the original creators.
Please consult Your own lawyer if You want more information about the state of current intellectual property law in Your jurisdiction. Your ownership of the Assets you created persists even if in subsequent months You downgrade or cancel Your membership.
不能利用 Midjourney 去侵害他人的智慧財產權

內容須授權給 Midjourney
使用者在使用服務時，即已將著作權授權給 Midjourney。意即允許 Midjourney 複製、製作衍生作品、公開展示、再授權和發布使用者輸入的提示詞（Prompt），以及生成的所有內容。
Rights You give to Midjourney
By using the Services, You grant to Midjourney, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable no-charge, royalty-free, irrevocable copyright license to reproduce, prepare derivative works of, publicly display, publicly perform, sublicense, and distribute text and image prompts You input into the Services, as well as any Assets produced by You through the Service. This license survives termination of this Agreement by any party, for any reason.
公開生成之內容、開放二次創作（Remix）
在一般情況下，使用者所產生的影像以及所使用的 prompt，是公開在Midjourney 社團中，且允許他人二創。如果使用者不想公開內容，就必須購買「Pro」或「Mega」方案中的「隱身」（Stealth）功能，Midjourney 才會「盡量」不公開使用者在啟用隱身模式時使用的提示詞及產生的內容。
Remixing and Stealth Mode
Please note: Midjourney is an open community which allows others to use and remix Your images and prompts whenever they are posted in a public setting. By default, Your images are publically viewable and remixable. As described below, You grant Midjourney a license to allow this.
If You purchased the Stealth feature as part of Your “Pro” or "Mega" subscription or through the previously available add-on, we agree to make best efforts not to publish any Assets You make in any situation where you have engaged stealth mode in the Services.
Please be aware that any image You make in a shared or open space, such as a Discord chatroom, is viewable by anyone in that chatroom, regardless of whether Stealth mode is engaged.
